Welcome to Tracksy. These Terms of Service ("Terms") govern your access to and use of the Tracksy mobile application (the "App"), operated by Tracksy ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By creating an account, you represent that you meet this requirement. If you are under 18, you must have parental or guardian consent to use the App.
2. Account Registration
- You may create an account using your email address and password, or through Google Sign-In.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate and complete profile information (age, gender, height, weight, activity level, and fitness goal) to enable the App to calculate personalized calorie targets.
- You are responsible for all activities that occur under your account.
- You must notify us immediately if you suspect any unauthorized access to your account.
3. Description of Services
Tracksy provides the following services:
3.1 Free Tier
- Calorie & Macro Tracking: Log meals with calorie, protein, carbohydrate, and fat tracking.
- Water Tracking: Log daily water intake with customizable daily goals.
- Daily Dashboard: View daily calorie and macro summaries, water intake progress, and basic weekly overview.
- Manual Food Logging: Add meals manually with custom nutrition values.
Free-tier users will see advertisements within the App.
3.2 Premium Tier
In addition to all Free features, Premium subscribers get access to:
- Barcode Scanner: Scan product barcodes to automatically retrieve nutritional information from the Open Food Facts database.
- AI Nutrition Coach: Receive personalized nutrition coaching, meal analysis, daily tips, and macro feedback powered by artificial intelligence.
- Supplement Tracker: Track supplements (vitamins, creatine, protein, etc.) with customizable reminders and adherence streaks.
- Advanced Analytics: Access weekly and monthly reports, trend analysis, and pattern detection.
- Data Export: Export your nutrition data in CSV or JSON format.
- Ad-Free Experience: No advertisements are displayed to Premium users.
4. Subscription & Payments
4.1 Pricing
- Monthly Plan: $4.99 per month
- Annual Plan: $39.99 per year
Prices are in US Dollars and may vary by region due to local taxes and currency conversion.
4.2 Billing
- All subscriptions are processed through Apple In-App Purchase (StoreKit).
- Payment is charged to your Apple ID account upon purchase confirmation.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price.
4.3 Free Trial
We may offer a free trial period for Premium features. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee.
4.4 Cancellation & Refunds
- You may cancel your subscription at any time through your Apple ID account settings.
- Cancellation takes effect at the end of the current billing period. You will retain Premium access until then.
- Refunds are handled according to Apple's refund policy.
- We do not provide direct refunds for in-app purchases.
5. AI Coaching Disclaimer
Important: The AI Nutrition Coach feature is designed for general informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
- AI-generated nutrition tips, meal suggestions, and coaching responses are based on general nutritional principles and your self-reported data.
- Always consult a qualified healthcare professional, registered dietitian, or physician before making significant changes to your diet, especially if you have medical conditions, food allergies, eating disorders, or are pregnant or nursing.
- We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
- Tracksy is not responsible for any health outcomes resulting from following AI coaching suggestions.
6. Barcode Scanner & Nutritional Data
- Nutritional information retrieved through barcode scanning is sourced from the Open Food Facts open-source database and other third-party providers.
- We do not guarantee the accuracy or completeness of nutritional data retrieved from external databases.
- You should verify nutritional information when accuracy is critical, particularly for medical dietary requirements.
7. User Conduct
By using the App, you agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to the App, other user accounts, or our systems.
- Upload or transmit harmful content, malware, or any material that infringes intellectual property rights.
- Use the AI Coach feature to generate content that is harmful, abusive, or unrelated to nutrition and fitness.
- Reverse engineer, decompile, or disassemble any part of the App.
- Share your account credentials with third parties.
- Use automated tools (bots, scrapers) to access the App.
8. Intellectual Property
- The App, including its design, code, features, content, and branding, is owned by Tracksy and protected by intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
- You retain ownership of the data you input into the App (meals, supplements, etc.).
- By using the AI Coach feature, you grant us permission to use your anonymized nutrition data to improve our AI coaching algorithms.
9. Data & Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the data practices described in the Privacy Policy.
10. Service Availability
- We strive to keep the App available at all times but do not guarantee uninterrupted access.
- We may temporarily suspend the App for maintenance, updates, or technical issues.
- Third-party services (AI coaching, barcode database, authentication) may experience their own downtime, which is beyond our control.
- We reserve the right to modify, suspend, or discontinue any feature of the App with reasonable notice.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
- Our total liability to you for any claim arising from the use of the App shall not exceed the amount you paid for Premium subscriptions in the 12 months preceding the claim.
- We are not responsible for health outcomes resulting from using the App's tracking or AI coaching features.
12. Indemnification
You agree to indemnify and hold harmless Tracksy, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
13. Termination
- You may delete your account at any time from the App's settings. This will permanently remove your data within 30 days.
- We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or misuse the App.
- Upon termination, your right to use the App ceases immediately. Any active subscription will not be refunded for the remaining period.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts in Istanbul, Turkey.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
